Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern your use of Agroconda, including the Agroconda mobile application, website, and related services (collectively, the "Service").

The Service is operated by Milkimiks d.o.o., OIB 77035239791, with its registered address at Ul. Petra Biškupa Vene 47, 43000 Bjelovar, Croatia ("Agroconda", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service and access arrangements

Agroconda provides tools for managing agricultural workspaces, parcels, crops, tasks, notes, images, maps, notifications, satellite observations, and related analytics.

The Service is available internationally where lawful. At launch, access, feature limits, and any commercial terms are agreed individually with each user or organisation. We may contact an applicant to understand the intended use and configure an appropriate workspace arrangement.

3. Accounts and workspaces

You must provide accurate account information, keep your credentials secure, and promptly notify us at support@agroconda.com if you believe your account has been accessed without authorisation.

You may create or join workspaces and invite other people where the Service permits it. Workspace administrators are responsible for managing membership and permissions. The Service is intended for professional and business use; if you use it on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation.

4. User Content

You retain ownership of content you submit to the Service, including parcel information, crop information, notes, tasks, photographs, and attachments ("User Content"). You grant Agroconda a limited, non-exclusive licence to host, store, process, reproduce, and display User Content solely as necessary to operate, secure, maintain, and provide the Service.

You confirm that you have the necessary rights and permissions to submit User Content and share it with workspace members.

5. Acceptable use

You must not use the Service unlawfully, access another account or workspace without permission, interfere with the Service or its security, upload malware or unlawful content, or attempt to reverse engineer, scrape, or bypass Service safeguards except where applicable law permits it.

6. Maps, satellite information, and AI analytics

Maps, satellite observations, weather information, and analytics are provided for informational purposes only. They may be incomplete, delayed, inaccurate, or unavailable.

Where you request an AI analytics feature, Agroconda may send relevant parcel, note, and image inputs to OpenAI to generate an analytics report. AI-generated analytics are assistive outputs, not professional agronomic, legal, financial, safety, or environmental advice. You remain responsible for all farming and operational decisions.

7. Commercial terms and payment

Agroconda does not publish a fixed public price list at launch. Access may be provided without charge, including as part of a separate commercial relationship with Milkimiks d.o.o., or under individually agreed commercial terms.

Where paid access, invoicing, or an in-app purchase is offered, the applicable price, taxes, renewal, cancellation, and refund terms will be presented before the arrangement takes effect. Apple App Store or Google Play terms may also apply to an in-app purchase.

8. Availability and changes

We aim to keep the Service available and secure, but do not guarantee uninterrupted or error-free operation. We may modify, maintain, suspend, or discontinue features where reasonably necessary. Where a change materially affects an agreed paid arrangement or your rights, we will provide notice where required by applicable law.

9. Suspension, termination, and deletion

You may stop using the Service and request deletion of your account in the app or at https://agroconda.com/delete-account.

We may suspend or terminate access where reasonably necessary to protect the Service, users, or our legal rights, including for serious or repeated breaches of these Terms.

10. Intellectual property

The Service, excluding User Content, is owned by Agroconda or its licensors and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of the Service to you.

11. Disclaimers and liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. To the fullest extent permitted by law, the Service is provided on an "as available" basis, and Agroconda is not responsible for decisions made solely in reliance on maps, satellite data, weather data, or analytics outputs.

13. Changes to these Terms

We may update these Terms from time to time. The current version and effective date will be published at https://agroconda.com/terms. Where appropriate, we will ask you to accept a materially updated version before continuing to use the Service.

14. Governing law and contact

These Terms are governed by Croatian law. This does not limit any mandatory consumer protections that apply to you. Questions about these Terms can be sent to support@agroconda.com.
